1. Scope of Agreement
These Terms of Service ("Terms") govern the use of the website https://nexgenerp.in and all professional consulting, implementation, customization, and Annual Maintenance Contracts (AMC) provided by NexGen Enterprises. By accessing our website or contracting our services, you agree to these Terms.
2. Enterprise Consulting & Implementation Services
NexGen Enterprises provides enterprise consulting for the open-source ERPNext software and Frappe Framework. Our standard services include:
- Business Process Gap Analysis and Statement of Work (SOW) formulation.
- Master Data Migration from Tally, SAP, legacy databases, or spreadsheets.
- Custom Frappe Application and DocType development.
- User Acceptance Testing (UAT), Pilot deployment, and end-user training.
- Ongoing Dedicated SLA Technical Support and Version Upgrades.
3. Code Ownership & 100% Data Sovereignty
We believe in total enterprise independence and zero vendor lock-in:
- Your Custom Code: All custom DocTypes, scripts, and applications developed specifically for your organization under a paid Statement of Work belong 100% to you.
- Your Data: All database ledgers, customer records, and transaction histories remain the sole property of your company. Production servers are provisioned on dedicated VPS / private cloud infrastructure owned directly by you.
4. Commercial Retainers & Infrastructure Billing
Our enterprise implementation and SLA retainer packages range between ₹5,00,000 – ₹6,00,000 per year based on organization scope and SLA requirements. Third-party VPS cloud hosting, domain registrations, SMS/WhatsApp API credits, and payment gateway transaction fees are billed separately at actual cost.
5. Service Level Agreements (SLA) & Support
Support retainers are governed by explicit response-time SLAs (under 15 minutes for critical production outages). NexGen Enterprises ensures regular automated database backup configurations and security hardening.
6. Governing Law & Jurisdiction
These Terms and any commercial agreements entered with NexGen Enterprises shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts in Gautam Buddha Nagar (Noida), Uttar Pradesh, India.
